TERMS AND CONDITIONS

Key Conditions for the Golden Harvest customers

  1. Under Golden Harvest Customer has to pay 10 (Ten) monthly instalments and his/her maturity would start after 300 [three hundred] days from the date of enrolment. For the purpose of Golden Harvest, the date of payment of first instalment shall be deemed as Enrolment date/date of joining.
  2. The Golden Harvest will allow the Customer to pay 10 (Ten) fixed monthly instalments of minimum Rs. 2,000/- (Rupees Two Thousand) or above (in multiples of Rs.1,000/- [Rupees One Thousand]). In a span of 10 (Ten) months, Customer has to pay one instalment every month. More than one instalment in a single month will not be accepted, however Customer shall be provided with grace period of 7 (Seven) days in a month for payment of instalment. In the event a Customer fails to pay the instalment within the grace period, the proportionate discount as offered herein shall be reduced.
  3. The Customers would be eligible for a discount of 75% (Seventy Five percent) of one month instalment upon completion of 365 (Three Hundred Sixty Five) days from the date of joining. If a Customer redeems after 300 (Three Hundred) days but before the completion of 365 (Three Hundred Sixty Five) days, discount ranging between 55% (Fifty Five percent) and 75% (Seventy Five percent) of one month instalment based on number of days will be available as discount. However, if the Customer wishes to pre-close Golden Harvest after paying 6 monthly instalments and after completion of 180 days but before 300 (Three Hundred) days from the date of first payment, Titan shall refund the amounts aggregating to the instalments paid by the Customer until the date of refund and provide a prorated discount voucher that the Customer can utilize to purchase Jewellery from the Company.

  1. The Customer is mandatorily required to redeem his/her account before 421 days from the date of payment of the first instalment.
  2. In case the Customer does not redeem within 421 days, he/she will be refunded with the aggregate instalment amount. A discount voucher for the applicable discount amount will also be provided. Subject to terms of Golden Harvest, any/all refund shall be made by Titan by way of cheque or by online transfer and no cash refund shall be permissible. PAN copy is required at the time of redemption if required under applicable Law.
  3. Golden Harvest can be redeemed only against the purchase of jewellery at Tanishq Stores.
  4. Golden Harvest account holder is required to provide a copy of his/her photo ID and address proof documents like Ration Card/Passport/Pan Card/Aadhar/Driving License/Voter ID etc., at the time of enrolment.
  5. Gold rate booked or charged on the invoice shall vary city wise depending on the Tanishq corporate gold rate applied by Titan. The rate of gold shall be based on the Tanishq rate of gold prevailing on the date of purchase.

Detailed terms and conditions:

  1. Account Opening & Enrollment:
    1. Only individuals can enrol in to the Golden Harvest and enrolment is not permissible for other entities like companies, partnership firms or proprietorship concern or Trusts or Hindu Undivided Family (HUF) or NRI Customers. Minors can enrol in to Golden Harvest only through their natural guardians. Golden Harvest cannot be enrolled by the Customer with his borrowed money.
    2. On enrolment, every account holder will be given a Golden Harvest Book which he/she is required to carry and keep under safe custody, at all times. The Account holder may also register at https://www.tanishqgoldenharvest.co.in/ to see his payment details. The account holder should ensure that, all payments made by them are correctly entered in the Golden Harvest Book / properly reflected in the online portal and if there is any discrepancy, it should be immediately brought to the respective store manager’s notice, for suitable rectification, especially the name of the account holder wherein the name should be as per the ID proof provided by the Customer and not in any other name, including nick name or short forms etc.
    3. At the time of enrolment, the account holder should ensure that, the Golden Harvest Book is signed by him/her and by the Tanishq Store Manager/Cashier, in the space provided, accepting terms and conditions as stated in the Golden Harvest Book to ensure the validity of Golden Harvest Book and for proper reference at the time of maturity/purchase.
    4. The bearer of the Golden Harvest book cannot be considered as the owner of the Golden Harvest book if there is any discrepancy as per the ID Proof, Titan reserves right to check the authenticity/ validity of the documents and person representing for redemption/refund at the sole discretion of Titan which is final and binding.
    5. In case of any change in contact or address details, the account holder is required to intimate Titan or email to tanishqcare@titan.co.in within 7 (seven) days from date of such change.
    6. Golden Harvest shall be denominated and utilized/redeemed in Indian Rupees only. Golden Harvest once selected cannot be converted which may be operated or implemented by Tanishq, from time to time.
    7. The maturity date shall be strictly calculated according to the first payment date made by the account holder.

  1. Monthly Payments:
    1. The account holder should ask for a computerized entry in the Golden Harvest Book or collect his/her duly computerized receipt, from the Tanishq Store where he/she is making payment. Customer can also make payment over the internet. However, the customer has to ensure to get his/her Golden Harvest Book updated periodically by producing payment receipts. For the purpose of the Golden Harvest, monthly due date shall be one month from the instalment due date.
    2. Receipt for payment made by Automated Clearing House (“ACH”) will be made only after clearance of payment. In case of ACH enabled accounts, Golden Harvest cannot be closed prior to maturity date unless the account holder has cancelled the ACH by submitting the required forms to Titan.
    3. Payment of monthly instalment(s) should be made on or before due date by cash, card, cheque and ACH in select stores, online payments, demand draft in favour of “Titan Company Limited” payable in the city and the Tanishq Store, where the account is opened on due date, irrespective of whoever operates the Store/s. Outstation cheques will not be accepted and international card for online payment will not be accepted.
    4. Titan will not be responsible for any online payment failure and money being debited from the Customer’s account. In case of any payment failure, the Customer is requested to check with their banks or other service providers. It is the responsibility of the account holder to enter details correctly. The monthly payments should reach once every month on or before the due date. Payments not reaching on or before the due date every month will be treated as default for that particular month and may result in lower discount, at the time of purchase.
    5. Tanishq Store or Titan will not be responsible or liable to send reminders for payments.

  1. Golden Harvest Transfer Process:
    1. The accounts opened under this Golden Harvest are transferable between different locations of Tanishq Stores only. The transfer of account can be made only in the name of the original Account Holder as mentioned in the Golden Harvest Book and the Golden Harvest Book should be produced at the transferee store along with photo ID proof by the account holder.

  1. Golden Harvest Redemption:
    1. At the time of purchase of jewellery upon maturity of Golden Harvest, the account holder has to personally come with his/her original Golden Harvest Book and affect the redemption of the instalments paid towards purchase of jewellery.
    2. At the time of purchase, the original Golden Harvest Book has to be submitted by the account holder to Tanishq Store (and his/her signature on redemption has to tally with the signature in the Golden Harvest Book).
    3. In addition to the gold and stone charges, all jewellery purchased under the Golden Harvest will be subject to labour charges, making charges, wastage charges, material charges, sales tax or value added tax or surcharges, levies as may be applicable/ prevailing at the time of purchase.
    4. Golden Harvest account has to be fully redeemed against the purchase of jewellery and no credit note or refund in any manner either in full or partial is permitted.
    5. In the event of any premature closure of the account by the account holder, such account holder may purchase jewellery at the Tanishq Store equal to the value of the instalments accumulated in his/her account as on that day. However, no discount on purchase of jewellery will be given in case of premature closure of the account where number of instalments paid is less than 6 instalments and below 180 days under any circumstances.

  1. Other Terms and Conditions:
    1. In the event of loss of the Golden Harvest Book, the account holder has to intimate the concerned Tanishq store or email to tanishqcare@titan.co.in immediately in writing, to enable Titan to block the account. In case of any delay or non-intimation, he/she shall be personally responsible for any loss or redemption /purchase by any other person.
    2. In the event of loss of the original Golden Harvest Book,
      • a duplicate Golden Harvest Book can be issued only if the account holder provides an indemnity letter and valid photo identity and address proofs, for authentication by the Tanishq Store. Titan shall not issue any duplicate Golden Harvest Book unless they are satisfied about the authenticity of the claim/request for duplicate Golden Harvest Book and only if the account holder produces in original all receipts given to him/her in the past.
    3. In the event of death of the account holder, the amount is transferable by Titan only to the person(s) whose nomination has been filled by the account holder in the form at the time of opening the account subject to such nominee producing Identity and address proof. In case the account holder does not wish to nominate any person, any claim(s) made by any other person(s) on behalf of the account holder will not be entertained unless such person being a legal heir/duly authorised person claiming the benefits in Golden Harvest account shall produce below documents to Titan:
      1. Death certificate of the deceased.
      2. Succession Certificate.
      3. NOC from other surviving legal heir for redemption.
      4. Indemnity undertaking to indemnify Titan from claims.
      5. Will (if any)
      6. Along with all other supporting documents and clarifications
      However, the decision of Titan shall be final on sufficiency of any document in all such cases above and the same shall be binding upon the claimants.
    4. The Titan reserves the right to alter, amend, add or delete part or whole of the privileges of the Golden Harvest without prior notice to the account holder, as long as the same is not detrimental to the interests of the account holder.
    5. Titan is the operator of Golden Harvest and reserves the right to suspend Golden Harvest at any time. In any such event, the account holder may purchase any item at the Tanishq Store equal to the value of the instalments accumulated in his/her Golden Harvest account along with discounts accumulated, as on that day.
    6. The liability of Titan or its franchisee(s) or Agents under Golden Harvest is limited to the extent of instalments/advances paid by the account holder(s) and the discount, as per Golden Harvest and conditions contained herein, and thus does not lead to any other assurance or warranty whatsoever by Titan.
    7. Any conditions which are explicitly not covered above, would be the discretion of Titan at the time of transaction/redemption. The decision of Titan in this regard would be deemed as irrevocable and final.
    8. Disputes if any will be subject to the Courts in Bangalore jurisdiction only, to the exclusion of any other Court's jurisdiction.
    9. In case of any change in existing laws, rules, Acts, etc. by any regulatory authority, Titan reserve its right to make such modifications/change/suspend/discontinue Golden Harvest suitable to the change of law and necessary requirements as per the same have to be complied with by the account holder.
  2. GH Enrollment On Or After 12-Aug-2020 (Current)
  1. The Golden Harvest Jewellery Purchase Plan (hereinafter “Golden Harvest” or the “Plan”) offered by Titan Company Limited (“Titan”/the “Company”) facilitates Customers to purchase Tanishq jewellery by making payments for the same over a ten month period and the Customers will be entitled to avail certain discounts subject to these Terms and Conditions.
  2. Under this Plan, the Customer has to pay 10 (Ten) fixed monthly instalments of a minimum of Rs. 2,000/- (Rupees Two Thousand) or above (in multiples of one thousand). During the course of the 10 (Ten) months, the Customer has to pay one instalment every month. More than one instalment in a single month will not be accepted.
  3. Customer will have to make the payment of the instalment on the Due Date. For the purpose of this Plan, the Due Date shall be same date as the Enrolment Date for the subsequent months. However, the Customer shall be provided with a grace period of 7 (Seven) days in a month for payment of the instalment. In the event the Customer fails to pay the instalment within the grace period, the proportionate discount as offered herein shall be reduced.
  4. The Plan will mature after 366 (Three Hundred and Sixty Six) days from the Enrolment Date and the Customers will be eligible to redeem by purchase of jewellery from the Company at the Tanishq stores. For the purpose of this Plan, the date of payment of first instalment shall be deemed as the Enrolment Date. The Customer is mandatorily required to redeem his/her account before the completion of 400 days from the Enrolment Date.
  5. The Customers would be eligible for a discount of 75% (Seventy Five percent) of one month’s instalment upon redemption, after the completion of 366 days from the Enrolment Date subject to the Customers having made the payment of all ten monthly instalments. If a Customer redeems before the completion of 366 (three hundred and sixty six) days but after the completion of 300 (Three Hundred) days, the Customer will be eligible for a discount ranging between 55% (Fifty Five percent) to 75% (Seventy Five percent) of one month instalment based on the number of days, and subject to the Customers having made the payment of all ten monthly instalments. For redemption after completion of 180 (One Hundred and Eighty) days but before completion of 300 (Three Hundred) days, Customer will be eligible for such prorated discount calculated based on the one month instalment, the number of days and the number of monthly instalments paid.
  6. The Customer will have the option to pre-close the Plan only if the Customer has paid a minimum of six monthly instalments and after completion of 180 days from the Enrolment Date. In the event of such pre-closure, customer may purchase jewellery at the Tanishq Store equal to the value of the instalments accumulated in his/her account as on that day. Alternatively, Customer may seek refund of the amount aggregating to the instalments paid by the Customer until the date of refund. The Customer will be provided with prorated discount voucher that the Customer can utilize to purchase jewellery from the Company for full value of the instalments paid. However, in the event the Customer has not paid the requisite minimum six monthly instalments, the Customer will not be eligible for any discount/discount voucher.
  7. In case the Customer does not redeem within 400 days, he/she will be refunded with the aggregate instalment amount paid by the Customer until the date of the refund. A discount voucher for the applicable discount amount will be provided which can be utilized only to purchase jewellery from the Company of a value that is equal to or greater than the full value of instalments paid.
  8. Refunds under the Plan, if any, will be made by way of cheque in the name of the account holder as specified in the Enrolment Form or by online transfer to the bank account as specified in the Enrolment Form, and no cash refund shall be permissible.
  9. Gold rate booked or charged on the invoice may vary city wise depending on the corporate gold rate applied by the Company. The rate of gold shall be based on the Company’s rate of gold prevailing on the date of purchase.
  10. Only individuals can enrol in to the Plan and enrolment is not permissible for other entities like companies, partnership firms or proprietorship concerns or Trusts or Hindu Undivided Family (HUF) or NRI Customers. Minors may enrol only through their natural guardians.
  11. Customers cannot enrol with his/her borrowed money.
  12. Enrolment may be through offline mode, i.e., at the Tanishq stores, or online by registering on the Golden Harvest website https://www.tanishqgoldenharvest.co.in or Golden Harvest Mobile Application.
  13. The Customer is required to provide a copy of his/her photo identity and address proof documents like Driving License/Voter ID/ Passport /Ration Card/PAN Card/any other document issued by the Government, bank account details, etc. at the time of enrolment.
  14. The Customer is required to register at https://www.tanishqgoldenharvest.co.in to manage his/her Golden Harvest Account. In case of any change in contact or address details or any other details that the Customer may have furnished, the Customer shall immediately contact customer care for effecting the changes. The Customer can however change the address details through the Golden Harvest website https://www.tanishqgoldenharvest.co.in or Golden Harvest Mobile Application as well, and any such modification made shall be subject to the satisfaction and discretion of Titan. The Customer should especially ensure that the name is as per the identity proof provided by the Customer, and not in any other name, including nickname or short forms and the bank account details and other details as provided in the Enrolment Form shall be accurate.
  15. Titan reserves right to verify the identity of the Customer by means of SMS and/or OTP generation or by any other means at any time including at the time of enrolment and at the time of concluding the purchase and taking the delivery of the jewellery. Titan also reserves the right to verify the authenticity of the documents provided by the Customer.
  16. At the time of enrolment, the Customer should ensure that, the Golden Harvest Enrolment Form is signed in the space provided, physically or electronically, as the case may be, accepting these terms and conditions.
  17. Payment of monthly instalment(s) may be made by cash, credit / debit cards, NEFT/ RTGS, local cheques in favour of “Titan Company Limited” payable in the city in where the Tanishq Store in which the account was opened is located, Standing Instruction or Automated Clearing House. International card for online payment will not be accepted. In case of cheque dishonour, the bank charges shall be borne by the Customers. Payments can be made at any of the Tanishq stores or through the Golden Harvest website https://www.tanishqgoldenharvest.co.in or Golden Harvest Mobile Application. Titan shall not be responsible for any online payment failure and money being debited from the Customer’s account. Customers are requested to check with their banks or other service providers for such payment failures. It is the responsibility of the account holder to enter details correctly.
  18. Receipt for payment made by Automated Clearing House (“ACH”) or Standing Instruction (“SI”) will be made only after clearance of payment. In case of ACH/SI enabled accounts, the Plan cannot be closed prior to maturity date unless the account holder has cancelled the ACH/SI by submitting the required forms to Titan. The Customer may ask for a computerized receipt, from any Tanishq Store.
  19. The Company or the Tanishq stores will not be responsible or liable to send reminders for payments.
  20. The accounts opened under this Plan are transferable between different locations of Tanishq Stores only. The transfer of account can be made only in the name of the original account holder as mentioned in the Enrolment Form and valid photo identity proof of such account holder should be produced at the transferee store. The Company reserves the right to satisfy the identity of the Customer in any manner it deems fit.
  21. At the time of purchase of jewellery, the account holder has to personally come and should produce a valid photo identity proof and PAN Card, if required under applicable law, and effect the redemption of the instalments paid towards purchase of jewellery. The Company reserves the right to satisfy the identity of the Customer in any manner it deems fit.
  22. In addition to the gold and stone charges, all jewellery purchased under the Golden Harvest will be subject to making charges, wastage charges, material charges, Goods and Services Tax, or any other surcharges, levies as may be applicable/ prevailing at the time of purchase.
  23. The Customer will have to purchase the jewellery for the total instalment amount paid and partial purchase is not allowed.
  24. The Customer may appoint a nominee at the time of enrolment upon submission of relevant documentation. In the event of death of the account holder, the amount is transferable by the Company only to the person(s) whose nomination has been filled by the account holder in the Enrolment Form at the time of opening the account subject to such nominee producing identity and address proof. In case the account holder does not nominate any person, any claim(s) made by any other person(s) on behalf of the account holder will not be entertained unless such person being a legal heir/duly authorised person claiming the benefits under the Plan, shall produce below documents to the Company:
    1. Death certificate of the deceased.
    2. Succession Certificate.
    3. NOC from other surviving legal heir for redemption.
    4. Indemnity undertaking to indemnify Titan from claims.
    5. Will (if any)
    6. Along with all other supporting documents and clarifications
    However, the decision of the Company shall be final on sufficiency of any document in all such cases above and the same shall be binding upon the claimants.
  25. The Company reserves the right to alter, amend, add or delete part or whole of the privileges of the Plan without prior notice to the account holder, as long as the same is not detrimental to the interests of the account holder.
  26. The Company is the operator of this Plan and reserves the right to suspend the Plan at any time. In any such event, the account holder may purchase any item at the Tanishq Store equal to the value of the instalments accumulated in his/her Golden Harvest account along with discounts accumulated, as on that day.
  27. The liability of the Company or its franchisee(s) or agents under Golden Harvest is limited to the extent of instalments/advances paid by the account holder(s) and the discount, as per the Plan and the terms and conditions contained herein, and thus does not lead to any other assurance or warranty whatsoever by the Company.
  28. Any conditions that are not explicitly covered above would be the discretion of the Company at the time of transaction/redemption. The decision of the Company in this regard would be deemed as irrevocable and final.
  29. Disputes if any will be subject to the Courts in Bangalore jurisdiction only, to the exclusion of any other court's jurisdiction.
  30. In case of any change in existing laws, rules, Acts, etc. by any regulatory authority, the Company reserves the right to make such modifications/change/suspend/discontinue the Plan suitable to the change of law and necessary requirements as per the same have to be complied with by the account holder.
  31. GH Enrollment Prior To 12-Aug-2020 (Previous)
